Terms of Service

The rules for using the Wicihitok Challenge app and website.

Effective date: March 29, 2025  ·  Last updated: March 29, 2025

By downloading the app or using our website, you agree to these Terms. If you do not agree, please do not use Wicihitok Challenge.

📱 The Service

Wicihitok Challenge ("we", "our", "us") provides a free mobile fitness application and supporting website (collectively, "the Service") that allows users to log daily exercise reps and contribute to a collective donation pool distributed to selected charities each month.

The Service is provided as-is. We may add, change, or discontinue features at any time.

Eligibility

🔐 Your Account

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. We use passwordless email authentication — do not share your sign-in codes with anyone.

If you believe your account has been compromised, contact us immediately at support@wicihitok.com.

🏋️ Acceptable Use

You agree not to:

We reserve the right to suspend or permanently ban accounts that violate these rules without prior notice.

💸 Donations & Payments

Wicihitok Challenge makes charitable donations on behalf of its user community each month based on aggregate rep counts. Individual users do not make direct financial contributions through the free app tier — we fund donations from subscription and ad revenue.

If you choose to donate directly or upgrade to a paid subscription:

Charity allocations are determined by us and may change monthly. We cannot guarantee a specific charity will receive funds in any given period.

👥 Teams

All users are automatically placed in the Wicihitok Challengers default team. You may join other teams, leave teams, or remain without a team at any time.

Team creation is currently restricted to users who have raised a minimum of $1,000 in fundraising, subject to admin review. Teams must comply with our community standards and may be removed if they violate these Terms or our policies.

📄 Your Content

You retain ownership of any content you submit (profile information, messages to support, etc.). By submitting content you grant us a limited licence to use it solely to operate and improve the Service.

You must not submit content that is unlawful, defamatory, discriminatory, or that infringes third-party rights.

🏛️ Intellectual Property

All app code, design, branding, challenge names, and website content are owned by Wicihitok Challenge or our licensors. You may not copy, distribute, or create derivative works without our express written consent.

⚠️ Disclaimers

Fitness advice — the app is for general wellness motivation only. Nothing in the Service constitutes medical advice. Consult a qualified health professional before starting any exercise programme.

Service availability — we aim for high uptime but do not guarantee the Service will be available at all times. We are not liable for losses resulting from downtime or data loss.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law.

🛡️ Limitation of Liability

To the fullest extent permitted by applicable law, Wicihitok Challenge shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the 12 months preceding the claim (or $50 if you have not paid anything).

🔄 Termination

You may stop using the Service and request account deletion at any time by contacting us. We may suspend or terminate your access if you breach these Terms, with or without notice depending on the severity.

Upon termination, provisions that by their nature should survive (intellectual property, disclaimers, limitation of liability, governing law) will continue to apply.

📜 Governing Law

These Terms are governed by the laws of Canada, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Canada, and you consent to the personal jurisdiction of those courts.

🔄 Changes to These Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date and, where appropriate, notify you via the app or email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
